The following are important details for you to know about our classes and services, prior to registering. By signing below you agree and acknowledge that you have read and accepted these policies. 1. PAYMENT

Payment: Payment in full is required to secure your reservation and must be guaranteed with a credit card at the time of making the reservation. We accept Visa, Master Card, and American Express.

2. REFUNDS/CANCELLATIONS

Class and Service Exchange Policy. There is a NO REFUND POLICY for any reason. Exchanges will be made for any canceled class as long as space is available (subject to a $55 admin fee). Changes made to scheduled services less than 24 business day hours prior to appointment, or no shows, forfeit payments. Changes to scheduling will be charged $55 admin fee on the third change and subsequent changes. ANI PHYO reserves the right to cancel or reschedule classes. In the event a class is canceled, all students will be notified and full refunds given. If a class is canceled, you may also choose to exchange to another class at no additional costs.

3. LIABILITY

Liability Waiver. The use of cooking utensils, including sharp instruments and equipment like knives and slicers can make cooking dangerous. ANI PHYO and its owners/agents will not be held responsible for any loss, injury or damage, to participants, or their property, due to any act or omission by the participants themselves, ANI PHYO or its agents. In case of accidental injury, self-service First Aid will be readily available and assisted First Aid will be quickly administered to any participant that verbally requests it.

In consideration of being permitted to participate in ANI PHYO’s certification course, the student, in full recognition and appreciation of the dangers and risks inherent in such activities, do hereby waive, release, and forever discharge ANI PHYO’s company and its officers, agents and employees, as well as ANI PHYO from and against any and all claims, demands, action or causes of action for costs, expenses or damages to personal property or personal injury, or death, which may result from my participation in these activities.

I understand and admit that my participation in ANI PHYO’s cooking classes is voluntary. I assume full responsibility for any injuries or damages resulting from my participation in this program including responsibility for using reasonable judgment in all phases of participation of the program and travel to and from the cooking location. I recognize and understand that the activities may be hazardous, that my participation is solely at my own risk, and that I assume full responsibility for any resulting injuries and damages. I also understand that this Waiver of Liability and Release binds my heirs, executors, administrators, and assigns as well as myself.

4. ALCOHOL POLICY

Alcohol Policy. Alcoholic beverages are occasionally used in our recipes and may be provided solely for such purpose by ANI PHYO. ANI PHYO does not serve, purchase or distribute alcoholic beverages for personal consumption.

Guests are solely responsible for their decision to consume alcoholic beverages during any program and that ANI PHYO shall have no responsibility or liability whatsoever to the guest or any third party for the consumption of those beverages or any consequences or actions related to the consumption of those beverages.

Alcoholic Beverages: Unless the class/event is a wine tasting, wine dinner, or otherwise noted, one (1) glass of wine will be served as an alternative to a selection of non-alcoholic beverages available to participants. Such alcoholic beverages will only be served to participants of legal drinking age (i.e., 21 years or older). Alcohol brought in from off premise will not be allowed. Any participants that come to class obviously intoxicated will be required to leave and will not be issued a refund. Class registration confirms acknowledgment and potential risks involved with the consumption of alcoholic beverages. ANI PHYO and its owners/agents will not be held responsible for any loss, injury or damage, to students due to the consumption of alcohol while attending our classes/events.

5. PHOTO, VIDEO, and MEDIA RELEASE

Photo and Appearance Release. ANI PHYO reserves the right to take photographic or film records of any of its programs, and may use any such photographic or film records for promotional and/or commercial purposes without any remuneration to the student/participant. The student agrees to assign all unlimited rights, title and interest they may have in or to any media in which their name or likeness might be used to ANI PHYO.

As a participant in ANI PHYO’s Raw Food Course you may be filmed or photographed. For good and valuable consideration, receipt of which is hereby acknowledged, I authorize ANI PHYO (“Company”) and her respective parents, affiliates, subsidiaries, licensees, successors and assigns to make use of my appearance as captured during ANI PHYO’s Raw Food Course (“Course”) and in connection with the Company or otherwise.

I agree that you may tape and photograph me, and record my voice, conversation and sounds, including any performance of any musical composition(s), during and in connection with my appearance and that you shall be the exclusive owner of the results and proceeds of such taping, photography and recording with the right, throughout the world, an unlimited number of times in perpetuity, to copyright, to use and to license others to use, in any manner, all or any portion thereof or of a reproduction thereof in connection with the Course or otherwise. For purposes of clarity, I expressly waive any and all moral rights I may have in connection with my appearance.

I further agree that you may use and license others to use my name, voice, likeness and any biographical material concerning me which I may provide, in any and all media and in the promotion, advertising, sale, publicizing and exploitation of the Course and/or otherwise and ancillary products (e.g., merchandise) in connection with the Course and in connection with Company or Company’s affiliated services, throughout the world in all media, an unlimited number of times in perpetuity. I further represent that any statements made by me during my appearance are true, to the best of my knowledge, and that neither they nor my appearance will violate or infringe upon the rights of any third party.

I acknowledge that you will rely on this permission potentially, at substantial cost to you and hereby agree not to assert any claim of any nature whatsoever against anyone relating to the exercise of the permissions granted hereunder.

Students are not allowed to record or video tape the certification course.

6. FOOD SAFETY/ALLERGIES

Food Safety. Participants must follow all food safety guidelines provided by the Culinary Instructors throughout the class. To prevent foodborne illness, participants experiencing or have been exposed to any communicable diseases including cold, flu, etc. should not be handling and/or preparing food and thus, should not attend cooking classes. Food Allergies and Dietary Restrictions: The food items that will be prepared in our cooking classes draw from vegan and raw food groups to create menus of a wide and varied collection of dishes. Therefore, in order to provide the full experience to our participants, we cannot accommodate severely restrictive diets such as macrobiotic, low carbohydrate/sugar, gluten intolerant or individuals with single ingredient allergies such as garlic or seeds and nuts. While we recognize that some individuals have very real and life threatening food allergies and/or severe dietary restrictions, our particular cooking class setting does not allow for us to accommodate those food issues. Class registration confirms your acknowledgment and acceptance of the potential risks associated with food allergies and dietary restrictions and holds harmless ANI PHYO and its owners/agents for any loss, injury or damage, due to allergic reactions that participant may suffer while attending our classes. However, if you decide to attend one of our classes and you have some specific allergies, make sure to announce it to the Culinary Instructor at the beginning of the class.

Consumption of Meals on Premises and Leftovers: Participants take full responsibility and liability for consuming food items prepared during class. For liability purposes, we discourage participants from taking home/removing leftover food items that were prepared during the class from the premises. However, if participants elect to do so, participants will assume all responsibility and liability for the proper transporting, storage, and/or reheating of these food items. Class registration confirms your acknowledgment and acceptance of the potential risks associated with consumption of meals prepared during class and taking home or removing leftover food items from the premises and holds harmless ANI PHYO and its owners/agents for any loss, injury or damage, to participants due to such action by participants.

7. Misconduct and Disciplinary Procedure

ANI PHYO reserves the right to terminate the training of any student at any time for misconduct, theft, use of alcohol or drugs, disruptive behavior, or other reasons, as they in their discretion shall think fit.

8. Smoking

Smoking is not allowed in class, including the patio area.

9. Cellular Phone

Cellular phones must either be turned “off” or placed on their “vibrate” function at all times while class is in session.

10. Children

With the exception of our children and family cooking classes, we cannot accommodate participants bringing children under the age of 16 years to adult classes.

11. Attendance Policy

Please make sure you arrive by the designated time each day. Ani has a lot of information to share in a short amount of time, so there isn’t any time to waste. If in the event you do arrive late, please notify us in advance. When you do arrive, please gather notes from other classmates and depending on time, Ani will do her best to answer any questions you may have after the day’s class.

12. MENU

Changes to Culinary Instructors, Descriptions, Content and Recipes: ANI PHYO reserves the right to change class Culinary Instructors, descriptions, content or recipes of any class/event without notice.

Menus. We reserve the right to substitute ingredients and menu items. However, we will make every effort to remain true to our advertised menu.

13. DRESS CODE

Appropriate Attire. For safety purposes, we discourage students from wearing high heels or open- toed sandals. Your safety is important to us. Our approach to demonstration-style classes may have you slicing, dicing, and blending your way through some of our recipes. Therefore, unless otherwise pre-approved, pants must be worn (no shorts, skirts, etc.), shirts must have sleeves, no high-heels are permitted, and closed-toed shoes ONLY are permitted (no sandals, flip flops, etc.). Long hair must be tied back, and short hair must be contained in a hair net or hat. If you arrive improperly dressed for class, the management reserves the right to not allow you to participate in the hands-on demonstrations, and you will not be eligible for a refund.

14. Ownership of IP & Materials

Ani Phyo is the sole owner of all course materials, recipes, and intellectual property, which are all copyrighted as such. Ani’s materials can not be used unless permissions are requested and granted in writing.
